THE HONOURABLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.1162 of 2016 ORDER :

Vide judgment dated 27.04.2015, while setting aside the order impugned, the District Registrar, East Godavari District was directed to receive any requisition made from the elected body of the petitioner-Society and to deal with the said requisition in accordance with law without regard to the provision contained in Section 23 of the A.P.Societies Act, 2001. The petitioners allege that, even though the requisition was submitted, as directed by the Court, no orders are passed causing hardship to them and such action of the District Registrar amounts to clear violation of the directions of this Court and, therefore, the respondent is liable to be punished under the Contempt of Courts Act, 1971. According to the respondent, in the affidavit filed in this Contempt Case, as the requisition was based on xerox copies, the petitioner was requested to submit the originals or certified copies and by the time the counter-affidavit is deposed, the original lists of governing body duly signed by all the elected members of the governing body was not submitted.

Having regard to the order passed by this Court and the averments made in the affidavit filed on behalf of the respondent, it cannot be said that the respondent has committed violation of the orders of this Court.

Accordingly, the Contempt Case is closed. However, it is needless to observe that the petitioners may institute appropriate proceedings on due compliance of the directions if the respondent

does not comply with the orders of this Court. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Contempt Case shall stand closed.
