THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.35528 OF 2015 ORDER:

The petitioner was appointed as Fair Price Shop dealer of Shop No.3 situated at Balkonda village and Mandal, Nizamabad District. While so, a show cause notice was issued to the petitioner in the month of October, 2015 asking her to submit her explanation in respect of four charges mentioned in the said show cause notice. The petitioner submitted her explanation on 17-10-2015 and on the same day, an order of cancellation of authorisation of the petitioner was passed. Challenging the same, the present writ petition is filed.

A perusal of the impugned order of cancellation of authorisation of the petitioner shows that no enquiry was conducted by the 2nd respondent after submission of explanation by the petitioner on 17-10-2015. In the circumstances, this Court is satisfied that the impugned order of cancellation of authorization of the petitioner suffers from violation of principles of natural justice and hence, it is liable to be set aside.

Accordingly, the writ petition is allowed at the stage of admission setting aside the impugned order, dated 17-10-2015 passed by the 2nd respondent. However, the matter is remitted to the 2nd respondent for conducting enquiry and passing fresh orders in accordance with law after giving due opportunity to the petitioner. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
