HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20492 of 2019 ORDER:

The only grievance of the petitioner in the writ petition is that without issuing any notice, the respondent-authorities are trying to demolish the function hall of the petitioner, which is constructed after obtaining permission from the competent authority.

Learned counsel for the petitioner submits that the respondents have informed the petitioner by pasting the notice dated 15-06-2019 on the subject premises, the petitioner is not aware of the same as the same is not pasted on the conspicuous place of the subject premises. Since the petitioner has all the necessary permissions, the petitioner may be permitted to file explanation to the show-cause notice dated 15-06-2019, till then no coercive steps shall be taken against the petitioner.

Heard Sri G.Narender Reddy, learned Standing Counsel for respondents.

Since the issue is pertaining to demolition, it is necessary that the respondents should follow the due process of law before taking action.

In view of the facts and circumstances of the case, since the petitioner is already aware and having copy of showcause notice dated 15-06-2019, it is open for the petitioner to file explanation within two weeks from today and the

competent authority to consider the same after granting opportunity of hearing to the petitioners and pass orders in accordance with law. Till then, no coercive steps shall be taken against the petitioner regarding the demolition of the subject premises. However, no further construction shall be made by the petitioner till then.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
