Kurva Narsappa, v. The Superintendent Of Police
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.20951 OF 2012 DATED 02nd JULY, 2015 Between:
Kurva Narsappa .. Petitioner and The District Superintendent of Police, Mahaboobnagar District and others .. Respondents
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.20951 OF 2012
O R D E R
The petitioner was aggrieved by the inaction of the police authorities on his complaint dated 14.05.2012 and legal notice dated 22.05.2012, whereby he sought protection to secure compliance with the order of interim injunction granted by the learned Junior Civil Judge, Gadwal, in I.A.No.96 of 2012 in O.S.No.61 of 2012. The said injunction was passed against respondents 3 to 5 herein. However, it is significant to note that there was no direction by the civil Court to the police authorities to afford protection to the petitioner to secure compliance with the order. In the absence of such a direction, the petitioner cannot assume as a matter of course that the police are under an obligation to provide protection and aid to him to secure compliance with the civil Court's order.
In the event there is any violation of an injunction order, law provides appropriate remedies to the person aggrieved. In that view of the matter, the writ petition is dismissed leaving it open to the petitioner to avail appropriate remedies in accordance with law. Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
