THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.10307 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed assailing the action of the 2nd respondent in demanding trade licence and fee under Sections 516, 521, 539, 622 and 623 of the Greater Hyderabad Municipal Corporation Act, 1955, in respect of the petitioner's shop situated in Vijayawada as illegal and arbitrary. The notices, dated 24.02.2016 and 25.02.2016, and the further action in demanding 'user charges', is also assailed as illegal and arbitrary. At the hearing, learned counsel for the petitioner and the learned Standing Counsel for the 2nd respondent fairly conceded that the issue involved in the present Writ Petition is squarely covered by the order of this Court, dated 21.07.2015, in W.P.No.30878 of 2012. A copy of the said order is placed on record.

Having regard to the facts and submissions and for the reasons alike, as were mentioned in the afore-stated order, this Writ Petition is allowed in terms of the afore-stated order and the impugned notices, dated 24.02.2016 and 25.02.2016, are set aside. The Registry is directed to enclose a copy of the afore-stated order, dated 21.07.2015, in W.P.No.30878 of 2012 to this order. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
