HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.23149 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India challenging the inaction of the fourth respondent in not considering the representations of the petitioner society dated 03.03.2016 as illegal, arbitrary and consequently direct the respondents to protect the rights and interest of the members of the Primary Fish Industrial Cooperative Society, Mandamarri Town and Mandal, Adilabad District and to pass such other necessary orders.

Heard the learned counsel for the petitioner and the learned Government Pleader for fisheries, learned Government Pleader for Cooperation, learned Government Pleader for Revenue, Sri M.Veera Swamy, learned counsel for the 2nd respondent and Sri N.Praveen Kumar, learned counsel for the 4th respondent. A perusal of the record reveals that the petitioner is a Primary Fish Industrial Cooperative Society, Mandamarri. The contention of the learned counsel for the petitioner is that the petitioner society is entitled for fishing rights over the tanks under the control of Mandamarri Municipality. A perusal of the record reveals that the Assistant Inspector of Fisheries, Laxettipet, and the Assistant Director of Fisheries addressed letters to the Commissioner of Municipality, Mandamarri on 01.03.2016 and 02.03.2016 respectively to lease out the tanks vested under the municipality to the existing Fishermen Cooperative Society, Mandamarri.

Having regard to the facts and circumstances of the case, the fourth respondent is hereby directed to consider the representation of the petitioner society dated 03.03.2016 and dispose of the same in accordance with law within a period of one month from the date of receipt of copy of this order. With the above direction, the writ petition is dispose of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
