HONOURABLE SRI JUSTICE S.RAVI KUMAR CIVIL REVISION PETITION No.1070 OF 2008 ORDER:

This revision is filed in the year 2008 and C.R.P.M.P.No.2331 of 2016 is filed to bring the petitioners as proposed respondents as legal representatives of the 6th respondent who died on 18-22015.

Though 6th respondent death was referred in the affidavit as 18-2-2015, the application was filed on 4-4-2016 and the affidavit is silent as to how the application is in time and why it was not filed within time. When the same is put to the advocate for the petitioners, she represented that she need some time to get instructions. Advocate for revision petitioners represented that as they have not informed about the death of 6th respondent to the proposed petitioners, therefore, the proposed petitioners are not aware of the death and pendency of C.R.P. When this court has asked the advocate for revision petitioners as to why the legal representatives of the deceased 6th respondent were not brought on record being a petitioner, learned counsel for revision petitioner represented that they are not aware of

the death of 6th respondent. Above two submissions of advocate for revision petitioner are inconsistent, and not matching with each other.

From the record, it appears the revision against R.5, R.6, R.7, R.8, R.10, and R.12 was already dismissed on 12-8-2011 for non-compliance of this Court order and a separate application is filed to condone delay of 695 days in filing application to set aside the dismissal order against all these respondents i.e., 5, 6, 7, 8, 10 and 12.

Considering these aspects, I am of the view that revision petitioners are not interested in prosecuting the case and accordingly, Revision is dismissed for nonprosecution. As a sequel to the disposal of this revision, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
