THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.3205 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in not transferring the ownership (license) stands in the name of G.Lakshmi Sai Prasad, Proprietor Sri Lakshmi Venkateshwara Saw Mill, Madhurawada, Kommadi Junction, Visakhapatnam with existing machinery in favour of Smt. G.Venkata Lakshmi (legal heir of original licensee G.Lakshmi Sai Prasad) is illegal, arbitrary, violation of Articles 14 and 19(1) (g) of the Constitution of India and contrary to the guidelines issued in G.O.Ms.No.91, dated 11.7.2006 and consequently direct the 3rd respondent to transfer the ownership (license) stands in the name of G.

Lakshmi Sai Prasad, Proprietor Sri Lakshmi Venkateshwara Saw Mill, Madhurawada, Kommadi Junction, Visakhapatnam with existing machinery in favour of Smt. G.Venkata Lakshmi (legal heir of original licensee G.Lakshmi Sai Prasad) and pass such other order or orders as this Hon'ble Court deemed fit and proper in the circumstances of the case."

When the matter is called, it is represented by the learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted a representation to the 3rd respondent on 31.03.2016 and further requested that the said representation may be directed to be disposed of by fixing some timeframe. The said request is not opposed by the learned Government Pleader and it is submitted by the learned Government Pleader that appropriate action will be taken, in accordance with law, on the said representation.

In view of the above, the writ petition is disposed of, without expressing any opinion on merits and demerits of the matter, directing the 3rd respondent - Divisional Forest Officer, Visakhapatnam, to take appropriate action on the representation dated 31.03.2016, said to have been submitted by the petitioner herein, within a period of four weeks from the date of receipt of a copy of this order, in accordance with law.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
