HON'BLE SRI JUSTICE T. AMARNATH GOUD CRIMINAL PETITION No.7070 of 2011 ORDER:

This criminal petition is filed, seeking to quash the proceedings in DVC No.5 of 2010 on the file of the Additional Judicial First Class Magistrate, Guntakal, Ananthapur District.

The 1st respondent herein is the complainant and petitioners herein are respondents 4 and 5 in the complaint and all of them belong to the same family. Serious allegations have been made by the complainant about the harassment against the petitioners/accused in the complaint which was forwarded to the Project Director (Protection Officer) District Women & Child Development Agency, Ananthapur.

Having regard to the allegations made in the complaint, the matter requires investigation. Therefore, this Court is not inclined to grant the relief sought in this petition.

The criminal petition is accordingly dismissed, directing the prosecution to proceed with the investigation in the crime in question in the light of Section 41-A Cr.P.C., and file final report. Till such time, the petitioners herein shall not be arrested. The petitioners shall cooperate with the investigation.
