HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL REVISION CASE No.924 of 2017 ORDER :

Heard learned counsel for the petitioner-Accused before admission and before notice to the 1st respondent - Commissioner, Tirupati Municipal Corporation, since the 2nd respondent - State is represented by the learned Public Prosecutor, this Criminal Revision Case is disposed of with a direction that if Crl.A.No.316 of 2016 is not disposed of by the lower appellate Court, not because of her latches, the petitioner-Accused is entitled to move an application before the lower appellate Court to consider for extension of time. Needless to say, even if the appellant is not cooperating for disposal of the appeal, the lower appellate Court is not powerless because it can, if necessary, by extending the time and by appointing a State brief as a Legal Aid Counsel, dispose of the appeal, as per the 3-Judges Bench expression of the Apex Court in BANI SINGH AND OTHERS Vs. STATE OF U.P.1. 2.

As a sequel, miscellaneous petitions pending, if any, in this revision shall stand closed.
