THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.1681 of 2015 ORDER :

The petitioners filed this Criminal Petition under Section 438 Cr.P.C., seeking release in the event of their arrest in connection with an unregistered Crime of Bowenpally Police Station, Rangareddy District.

At the time when the matter is taken up for hearing, the learned Additional Public Prosecutor submitted that till today no report is received against the petitioners, as such no crime is registered. Learned counsel for the petitioners submits that in view of exchange of notices between the parties, there is every likelihood of the informant giving a report under Section 498-A I.P.C. In view of the above submission, if any such complaint is registered against the petitioners, the investigating agency shall follow the procedure under Section 41-A Cr.P.C. With the above direction, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions, if any, pending in this Criminal Petition, shall stand dismissed.
