Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

It is the case of the petitioner that he is the Ex-President of Fishermen Cooperative Society of China Mandava Village, Chintakani Mandal, Khammam District No Confidence Motion was moved against him when he was acting as President and resolution was passed on 08.08.2007 and 11.09.2007 and ultimately a Motion was carried out in the meeting presided by the 2nd respondent on 23.10.2007. Consequently, the 2nd respondent gave charge to the 4th respondent, who is the Vice President of the society. It is also the case of the petitioner that even though he was removed as a President of the society after passing the resolution, he was not allowed to participate in the affairs of the society.

It is his further case that there is no resolution removing his membership from the society and that he submitted several representations to the authorities concerned seeking re-issuance of membership of the society. In the absence of any resolution removing the petitioner being a Member of the society, it cannot be assumed that the petitioner was removed as Member of the society. It is for the 4th respondent to allow the petitioner to continue as a Member basing on the record available with the society. In the event of the petitioner possessing any record with regard to removal of his membership, it is open to him to take necessary legal steps against the said order. Accordingly, the writ petition is disposed of. There shall be no order as to costs.

Pending miscellaneous petitions in this Writ Petition, if any, shall stand closed in consequence.
