THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.5534 OF 2018 ORDER:

This Criminal Petition, under Sections 437 and 439 of the Code of Criminal Procedure, 1973, is filed by the petitioners/A.1 and A.3, for grant of bail in Crime No.230 of 2018 of Hayathnagar Police Station, Rachakonda, registered for the offences punishable under Section 8(1) read with Section 20(b)(ii)(B) of NDPS Act, 1985 (As amended in 2001).

Heard the learned counsel for the petitioners/A.1 and A.3 and the learned Additional Public Prosecutor representing the respondent-State and perused the record.

Learned counsel for the petitioners would submit that the petitioners are innocent persons and falsely implicated in this case and nothing was recovered from their possession. 4.

Learned Additional Public Prosecutor opposed the grant of bail to the petitioners/A.1 and A.3.

As per the material placed on record, 48 packets of ganja weighing kgs was seized from the possession of the petitioners/A.1 and A.3 under a cover of panchanama on 27.03.2018 in the presence of mediators. The contraband seized is of commercial quantity. It cannot be held that the petitioners are falsely implicated in this case. Further, it cannot be held that the petitioners would not repeat similar offence in future after release on bail. The investigation is in progress. There are no circumstances to consider the application of the petitioners.

Hence, the petition is dismissed.

Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
