HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.5914 OF 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of the proceedings in Spl.S.C.No.43 of 2019 on the file of the V Additional District Sessions and Special Court for Trial of SC/STs (POA) Act Cases at Adilabad.

A charge sheet came to be filed against the petitioner for the offences punishable under Sections 290 of the Indian Penal Code and Section 3(1)(s), 3(2)(va) of SC/STs (POA) Act, 1989. Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioner restricts his prayer seeking dispensation of the presence of the petitioner before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of petitioner-accused is not in dispute, his presence in the above Spl.S.C. may not be necessary on every date of adjournment. Having regard to the facts and circumstances of the case, the personal appearance of the petitioner/accused in Spl.S.C.No.43 of 2019 on the file of the V Additional District Sessions and Special Court for Trial of SC/STs (POA) Act Cases at Adilabad, is hereby dispensed with except on the dates when his presence is specifically required by the Court.

With the above direction, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous applications, if any, pending in this Criminal Petition, shall stand closed.
