HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.20481 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of learned counsel for the respective parties. This writ petition is filed seeking the following relief :- " .....to issue an appropriate writ, order or direction more particularly one in the nature of a Writ of Mandamus directing Respondent No.5 to pay the remuneration to the petitioner for the services being rendered by him as a hereditary Oggu Pujari of Sri Mallikarjunaswamy Vari Devasthanam, Komuruvelli, Siddipet District, for the years 2016-17, 2017-18 and 2018-19 ......" .

Heard Mr.Prabhakar Sripada, learned counsel for petitioner and the learned Government Pleader for Endowments. It has been contended by the petitioner that he is working as Oggu Pujari in the 5th respondent Temple since more than thirty years.

The grievance of the petitioner is that though he has been discharging his duties to the best satisfaction of his superiors and every one concerned, the respondents are not paying remuneration for the years 2016-17, 2017-18 and 2018-19. In those set of circumstances, he got issued a legal notice on 17.07.2019. In spite of receiving the said legal notice, the respondents are not paying remuneration for the above said period. Learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the respondents to consider the case of the petitioner for payment of remuneration for the above said period.

Learned Government Pleader appearing for the respondents contends that if the petitioner submits fresh representation, the respondents would consider the same and pass appropriate orders in accordance with law.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a fresh representation to the respondents within two weeks from the date of receipt of a copy of this order seeking remuneration for the years 2016-17, 2017-18 and 2018-19. Upon such representation being received, the respondents shall consider the same and pass appropriate orders in accordance with law within a period of eight weeks thereafter.

With the above observations, the writ petition is disposed of. No order as to costs.
