THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.4708 OF 2013 ORDER:

This writ petition is filed challenging the notice issued under Section 452 (2) of the Hyderabad Municipal Corporation Act, 1955 (for short, 'the Act').

This Court by order dated 18.02.2013 directed the respondents not to demolish petitioners building and the said interim order was extended from time to time. 3.

Admittedly, it is only a notice issued under Section 452 (2) of the Act alleging unauthorized construction. Therefore, it is always open to the petitioners to submit their explanation and offer their views on the allegation made against them.

The Writ Petition is accordingly disposed of granting liberty to the petitioners to submit a fresh representation within three weeks from the date of receipt of a copy of this order. On submission of such representation, the respondent - Corporation shall consider the same and pass appropriate orders as warranted by law. Until a decision is made by the respondent - Corporation, no coercive action shall be taken against the petitioners. Pending miscellaneous petitions shall stand closed.
