HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 1966 of 2010 Order:
This Writ Petition was filed to declare the letter dated 04.12.2009 of the third respondent in seeking permission from the second respondent to permit the petitioner to withdraw his resignation made voluntarily to the post of Lecturer in Zoology as arbitrary, discriminatory and contrary to law and consequently direct the third respondent to forthwith permit the petitioner to withdraw his resignation made to the said post, in terms of the Memo No.603/Admn.V.2/2009, dated 30.09.2009, without insisting for permission from the second respondent and with all consequential benefits, including continuity of service and all other attendant benefits, monetary or otherwise with effect from 15.06.2009.
2. This Court, by an order dated 03.02.2010, while admitting the Writ Petition, directed the respondents to permit the petitioner to join duty as Lecturer in Zoology in the third respondent-College and continue as such until further orders.
3. When the matter is taken up for hearing, learned counsel for the petitioner submits that pursuant to the said interim directions the petitioner was taken into service and he is being continued till today.
4. Since the matter relates to the withdrawal of resignation before it was accepted, this Court feels that no adjudication is necessary in the present case in view of reinstatement of the petitioner pursuant to the interim orders.
5. The Writ Petition is, accordingly, closed. There shall be no order as to costs.
6. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
