THE HON'BLE SRI JUSTICE R.SUBHASH REDDY AND THE HON'BLE JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.33359 of 2015 ORDER: (Per Hon'ble Sri Justice R.Subhash Reddy) This writ petition is filed for a Mandamus to direct the 3rd respondent not to deal in any manner including alienating, transferring or creating charge in respect of Flat No. DAB-1708 in the 17th floor of the building known as Lanco Hill Technology Park at Manikonda Village, Ranga Reddy District, pending disposal of the complaint in C.C.No.343 of 2014 filed before the 2nd respondent - State Consumer Disputes Redressal Commission at Hyderabad for the State of Telangana.
By order dated 09.10.2015, this Court, while issuing notice before admission, granted interim direction as prayed for. The petitioners approached this Court only on the ground that the Chairman to the 2nd respondent Commission was not appointed and as such, the 2nd respondent Commission was not functioning. Today when the matter is called, it is submitted that the Chairman to the 2nd respondent Commission is appointed and the Commission started functioning.
In that view of the matter, we deem it appropriate to dispose of the writ petition permitting the petitioners to pursue the complaint in C.C.No.343 of 2014 pending before the 2nd respondent Commission. However, the interim order, dated 09.10.2015, passed by this Court shall continue for a period of four weeks from today. It is made clear that the 2nd respondent shall consider the complaint of the petitioners on its own merits, uninfluenced by any of the observations made in
this order.
Subject to the above, the writ petition is disposed of. No order as to costs.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
