THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3842 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in C.C.No.607 of 2011 on the file of the XIV Chief Metropolitan Magistrate, Hyderabad, arising out of offences under Sections 420 read with Section 511 IPC and Section 18(c) of the Drugs and Cosmetics Act.

Heard and perused the material available on record. Learned counsel for the petitioner submits that though the petitioner has filed an application before the Court below seeking split of the case, the Court below did not pass any orders and as such, prays this Court to give direction to the Court below to dispose of the said application as soon as possible.

Admittedly the case pertains to 2011 and that A.1 has been absconding from the date of initiation of the case. Hence, the Court below is directed to dispose of the application filed by the petitioner seeking split of the case, within a period of one month from the date of receipt of copy of this Order.
