W.P.No.8581/2017 WRI T PETI TI ON No.8581 of 2017 ORDER: (Per Hon'ble Sri Justice V. Ramasubramanian) The petitioner has come up with the present writ petition, aggrieved by the inaction on the part of the 2nd respondent in issuing a No Due Certificate.

2. Heard Mr. P. Balaji Varma, learned counsel for the petitioner and Mr. S. Suri Babu, learned Special Standing Counsel for the respondents.

3. After filing of the writ petition, the 2nd respondent has issued a notice dated 13.03.2017, directing the petitioner to produce the tax paid particulars with original documentary evidence, relating to the assessment years 2004-2005 under the APGST Act, and 2008-2009 and 2014-2015 under the AP VAT Act. The petitioner is prepared to produce the documentary evidence. If no evidence could be produced, then it follows naturally that the petitioner should pay the amount.

4. Therefore, the writ petition is disposed of directing the petitioner to appear before the 2nd respondent and produce original documentary evidence. If no evidence could be produced, the petitioner should then at least make the payment of demand. Thereafter, the 2nd respondent may issue a No Due Certificate.

5. As a sequel, pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
