THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No. 24598 of 2015 ORDER :

Heard learned counsel for the petitioner and learned Government pleader for R.1 and Sri T. Bala Swamy, Standing counsel for R.2.

2. The petitioner claims to be the owner and possessor of land admeasuring 280 Square yards in N.T.S.No.22, Revenue Ward No.11, Kadiyalavari Street, Hanumantharaya Nagar, Moghalrajpuram, Vijayawada, Krishna District. The petitioner alleges that earlier when the 3rd respondent encroached into 120 Square yards of land of the petitioner and constructed a small shed, he made several representations to the 2nd respondent. As no action was taken, the petitioner filed W.P.No.12697 of 2014 and this Court directed the 2nd respondent to take necessary action on the representation of the petitioner. In compliance of the said order the 2nd respondent issued notice to the 3rd respondent and demolished the structure and possession was handed over to the petitioner.

The petitioner further alleges that, he made an application for change of his name in the Municipal records on 10.11.2014 and the authorities directed the petitioner to submit copies of the documents along with necessary fee. On 02.03.2015 the petitioner submitted a representation along with necessary documents and demand draft for Rs.6,600/- in favour of 2nd respondent. Since no orders are passed on the representation of the petitioner, this writ petition is filed.

3. When the matter is taken up, both counsel agreed for disposal of the writ petition with a direction to the 2nd respondent to expeditiously dispose of the representation dated 02.03.2015, submitted by the petitioner.

4. Having regard to the same, without expressing any opinion on merits of the matter, writ petition is disposed of directing the 2nd respondent to consider the representation of the petitioner dated 02.03.2015, and pass appropriate orders as warranted under law within a period of four weeks from the date of receipt of copy of this order and communicate the decision to the petitioner. There shall be no order as to costs. Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
