Heard the learned counsel for the petitioner/accused, learned Public Prosecutor for the 1st respondent State and the learned counsel for the 2nd respondent/complainant. 2.
The facts of the case are that the present Criminal Revision Case is filed against the orders passed in Crl.A.No.125 of 2011 dated 27.1.2012 on the file of the Special Judge for trial of cases under SCs & STs (PoA) Act-cum-Additional District and Sessions Judge at Vizianagaram confirming the judgment passed in CC.No.436 of 2010 on the file of the Additional Judicial Magistrate of First Class, Vizianagaram. 3.
During the pendency of the present Criminal Revision Case, the 2nd respondent/complainant filed an application in I.A.No.3 of 2018 to record compromise and allow the present Criminal Revision Case by setting aside the judgment dated 27.1.2012 passed in Crl.A.No.125 of 2011 on the file of the Special Judge for trial of cases under SCs & STs (PoA) Act-cumAdditional District and Sessions Judge at Vizianagaram confirming the judgment passed in CC.No.436 of 2010 on the
file of the Additional Judicial Magistrate of First Class, Vizianagaram.

In fact, a joint memo is also filed by the petitioner and the 2nd respondent wherein it is stated that at the intervention of the elders and well-wishers, the matter has been amicably settled between the petitioner/accused and the 2nd respondent/complainant, pursuant to which, the 2nd respondent complainant received the cheque amount of Rs.1,00,000/- and as such, the 2nd respondent has no objection if the present Criminal Revision Case is allowed.

The parties have been identified by their respective counsel. The photo identity proofs of both the parties have been placed on record.

Taking into consideration, the averments made in I.A.No.3 of 2018 and the joint memo filed by the petitioner and the 2nd respondent, this Court deems it appropriate to allow the present Criminal Revision Case by setting aside the judgment passed in Crl.A.No.125 of 2011 dated 27.1.2012 on the file of the Special Judge for trial of cases under SCs & STs (PoA) Actcum-Additional District and Sessions Judge at Vizianagaram confirming the judgment passed in CC.No.436 of 2010 on the file of the Additional Judicial Magistrate of First Class, Vizianagaram.

I.A.No.3 of 2018 which was filed to record compromise, is ordered. Accordingly, the Criminal Revision Case is allowed and the judgment passed in Crl.A.No.125 of 2011 dated 27.1.2012 on the file of the Special Judge for trial of cases under SCs & STs (PoA) Act-cum-Additional District and Sessions Judge at Vizianagaram, confirming the judgment passed in CC.No.436 of 2010 on the file of the Additional Judicial Magistrate of First Class, Vizianagaram, is set aside.
Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
