ORDER

This writ petition is filed with the following prayer; "to issue a Writ, order or direction more particularly in the nature of Writ of Mandamus declaring the inaction on the part of Respondent Nos.2 to 4 in taking action against the illegal and unauthorized construction of first, second and third floors and also without leaving setbacks by Respondent No.5 over 160 Sq. yds of land bearing alleged H.No. 5-4-1592/12, Plot Nos.38 and 39 Phase IV, Road No 21, Sharadha Nagar Vanasthalipuram, L B Nagar Zone, Ranga Reddy District, consequently to direct Respondent No. 2 to demolish the illegal and unauthorized construction made therein and also to direct Respondent No.5 not to make any further illegal construction".

Learned counsel for the petitioner Mr. V. Srinivas submits that though the petitioner gave a representation to the respondent Corporation to take action on the illegal constructions being made by the unofficial respondent No.5, no action has been initiated by the respondent Corporation.

Learned counsel for the unofficial respondent No.5 Mr. R.A. Chary submits that he will file a counter affidavit. 4.

Learned Standing Counsel for respondent Nos.2 to 4 Mr. Sampath Prabhakar Reddy, on instructions, submits that after considering the representation of the petitioner, the respondent Corporation has already issued a show cause notice to the unofficial respondent No.5 and they will take further action.

Recording the submission of the learned Standing Counsel, the Writ Petition is disposed of directing the respondent Corporation to take further action pursuant to the show cause notice in accordance with law within a period of four weeks from the date of receipt of a copy of this order. No order as to costs.

Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
