THE HON'BLE SRI JUSTICE SREENIVAS RAO CRIMINAL PETITION No.8411 of 2025 Order:

This Criminal Petition is filed by the petitioner/accused, seeking anticipatory bail under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), in connection with Crime No.553 of 2025 of RGI Airport Police Station, Ranga Reddy District, registered for the offence punishable under Section 69 of Bharatiya Nyaya Sanhitha, 2023. 2.

The case of the prosecution in brief is that on 14.06.2025 that complainant is engaged in Airport customer services and during her tenure she came into contact with the petitioner who is senior supervisor and entered into a relationship and promised to marry her and believing him she involved in physical relationship and eventually came to know about the said relationship and the petitioner convinced her to resign from job saying that his family may not accept a working woman and accordingly she resigned her job and later when the de-facto complainant asked her she dogged the matter and recently came to know that the petitioner is getting married to another girl on 19.06.2025 and when she went to confront him, he denied their relationship and his family members threatened her and while she was returning home, the petitioner followed her and after the said confrontation, she was under

depression and attempted suicide. Basing on the said complaint, the present crime is registered for the aforesaid offences. 3.

Heard Mr. Kyadeveni Nagaraju, learned counsel for the petitioners and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner has not committed any offence and he was falsely implicated in the present crime. The petitioner and the de-facto complainant are known each other since long time, hence, the ingredients under Section 69 of BNS are not attract. The de-facto complainant made omnibus allegation against the petitioner and his family members with an intention to harass them. The petitioner is eking out his livelihood by doing Staff Assistant in RGI Airport and he is not having any criminal antecedents and he is ready and willing to cooperate with the investigation and also ready to abide by the conditions, which are going to be imposed by this Court and hence, prayed for anticipatory bail.

On the other hand, learned Additional Public Prosecutor submitted that there are specific allegations leveled against the petitioner in the complaint. The petitioner has committed grave offence and the investigation is under progress and at this stage if the petitioner is

enlarged on anticipatory bail, there is every chance to influence the witness and interfere with the investigation. Hence, the petitioner is not entitled for grant of anticipatory bail.

Having considered the rival submissions made by the respective parties and after perusal of the material available on record, it reveals that even according to the allegations made in the complaint, the petitioner and the de-facto complainant are know each other since 1 1⁄2 year. Even according to the learned Additional Public Prosecutor, the petitioner is not having criminal antecedents and 3 witnesses were examined.

Taking into facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner/accused subject to the following conditions.

1. The petitioner/accused shall surrender before the Station House Officer of RGI Airport, Cyberabad Commisionerate, on or before 23.07.2025, and on such surrender, the said Station House Officer shall release the petitioner/accused on bail executing a personal bond for Rs.30,000/- (Rupees thirty thousand only) with two sureties, for a like sum each.

2. After release, the petitioner/accused shall appear before the concerned SHO at 11.00 A.M. on every Saturday, for a period of eight (8) weeks or till filing of charge sheet

whichever is earlier, for the purpose of investigation and thereafter, as and when required.

3. After release, the petitioner/accused shall not influence the witnesses or interfere with the investigation.

4. After release, if the petitioner/accused indulges in similar offence, the respondent-State is entitled to file an application seeking cancellation of the anticipatory bail granted by this Court in favour of the petitioner.

5. The petitioner/accused shall not contact the de facto complainant/victim or her family members in any manner.

6. The petitioner/accused shall abide by the other conditions stipulated in Section 482 (2) Bharatiya Nagarik Suraksha Sanhitha, 2023 and co-operate with the Investigating Officer in investigating the case.
