HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.3026 of 2018 ORDER:

Aggrieved by the dismissal of the application for appointment of an Advocate Commissioner in a suit for a permanent injunction, the defendants have come up with the above revision.

2. Heard Mr. T. Rajinikanth Reddy, learned counsel for the revision petitioners.

3. The suit was one for permanent injunction to protect possession. Therefore, it is for the plaintiff to prove his title and/or his possession. The appointment of an Advocate Commissioner to note down the physical features in such cases would only tantamount to collection of evidence. Therefore, the trial Court is right in dismissing the application. Hence, the Civil Revision Petition is dismissed. No costs.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
