HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.17759 of 2018 ORDER:

This writ petition is filed seeking a writ of Mandamus to declare the action of the respondents 3, 4 and 6 in interfering with the possession/ construction of the petitioners' houses in the plots granted through possession patta on 14.02.2005 in Sy.No.237/ 4 in Kakinada vide Ref.No.9/ 2005 by the respondents 4 and 5, as illegal and arbitrary, and consequently direct the respondents not to interfere with the possession/ construction of the petitioners' houses in the respective plots of the petitioners.

2. Heard Sri Ch.Samson Babu, learned counsel for the petitioners and Sri Ancha Pandu Ranga Rao, learned Standing Counsel for the respondents 3 and 4.

3. It has been submitted by the petitioners that they were granted Pattas way back in 2005 and thereafter, they have constructed pacca houses in their respective plots. The petitioners further submitted that while the matter stood thus, the respondents are trying to interfere with their possession and enjoyment, and also trying to dispossess them from the said land.

4. Learned Standing Counsel appearing for the respondents 4 and 5 contends that the petitioners will not be dispossessed without following the due process of law.

5. Having regard to the submissions made by both the parties, the writ petition is disposed of directing the respondents not to

dispossess or interfere with the peaceful possession of the petitioners over the subject land without following the due process of law.

6. As a sequel thereto, miscellaneous petitions, if any, pending shall stand dismissed. No order as to costs. _______________________ ABHINAND KUMAR SHAVILI, J May 17, 2018 KTL
