Heard learned Assistant Government Pleader for Women Development and Child Welfare 3.
Petitioner is the mother of respondent No.5. She sought for cancellation of registered gift settlement deed bearing Document No.322 of 2011, dated 15.03 .2011 executed by her in favour of respondent No.5 by way df submitting representation dated 21.08.2025 with respondent No.3. Despite receiving and acknowledging the said representation, respondent No.3 did not act upon the same. Aggrieved by the \ \ \ \ said inaction of respondent No.3, petitioner filed the present writ petition.

As per Section 23(l) of the Maintenance and Welfare of Parents and Senior Citizens Act,2007 (for short, 'the Act, 2007'), it is respondent No.2, who is the competent Authority

lrr to cancel the said registered gift settlement deed. Instead of submitting application to respondent No.2, she has submitted representation to respondent No.3. Respondent No.2 is the Competent Authority.
5- In the light of the same, notice to respondent No.5 is dispensed with. This writ Petition is disposed of granting liberty to petitioner to submit appropriate application with respondent No.2 in terms of the Act,2007 seeking cancellation of the gift settlement deed and on filing of such application, respondent No.2 shall dispose it of strictly in accordance with the procedure laid down under the Act, 2007 Miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
