HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITON No. 18828 of 2007 O R D E R:

When the matter came up for hearing, learned counsel for petitioner submitted that though the petitioner is fully eligible and qualified for promotion to the post of Deputy Executive Engineer, the respondent did not consider his case for promotion, which is illegal and arbitrary.

Learned Standing Counsel appearing for respondentcorporation given an undertaking to the effect that the case of the petitioner for promotion to the post of Deputy Executive Engineer will be considered in accordance with the rules whenever they fill up the said post.

In view of the above submissions, the writ petition is disposed of directing the respondents to consider the case of the petitioner whenever they will up the post of Executive Engineers, in accordance with law. No costs.

Miscellaneous Petitions, if any, pending in this writ Petition shall stand closed.
