THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26060 of 2015 ORDER:

The petitioner was appointed as a fair price shop dealer of Kunukuntla Village, Tadimarri Mandal in Anantapur District. On the basis of the report submitted by the Tahsildar, dated 13.07.2015, a show cause notice was issued to the petitioner on 20.07.2015.

The petitioner submitted his explanation on 24.07.2015. After receipt of the explanation, the authorization of the petitioner was suspended on 30.07.2015. Challenging the same, the present Writ Petition is filed.

Six charges are alleged against the petitioner and a perusal of the said charges shows that they require further enquiry. In the circumstances, this Court is not inclined to interfere with the enquiry process at this stage and as the petitioner had already submitted his explanation, the third respondent is directed to conduct the enquiry in respect of the charges by giving due opportunity to the petitioner and pass final orders thereon, within a period of thirty days from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
