The Hon'ble Sri Justice C.V.Nagarjuna Reddy and The Hon'ble Sri Justice G.Shyam Prasad Writ Appeal No.690 of 2016 Date: 09.08.2016 Between:

O.Suryanarayana ..Petitioner/Appellant and The State of Andhra Pradesh rep. by its Prl.Secretary School Education Dept., Secretariat, Hyderabad and 5 others.

..Respondents Counsel for the Appellant: Mr.Kasa Jagan Mohan Reddy Counsel for respondent Nos.1 & 2: GP for Education (AP) Counsel for respondent Nos.3 to 6: Mr.C.Sunil Kumar Reddy The Court made the following:

Judgment: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) A seemingly simple issue of transfer snowballed into a major controversy with the appellant on one side and the management of the

educational institution on the other side taking extreme postures.

While the present Writ Appeal arises out of the interlocutory order, dated 13-07-2016, in WP.No.38517 of 2014 whereby the learned Single Judge has declined to pass an order in favour of the appellant for permitting him to work at his original place viz., Khammam on the ground that he was transferred to a School at Ravipadu, which is being run by the same management, it has come out at the hearing that two other Writ Petitions viz., WP.No.31773 of 2014 filed by the Management and WP.No.14231 of 2016 filed by the appellant are pending. It is further informed that WP.No.14231 of 2016 filed by the appellant is in the today's cause list before the learned Single Judge.

As the present Writ Appeal arises out of an interlocutory order and the main Writ Petition is pending, we are not inclined to adjudicate the Writ Appeal on merits.

Considering the fact that the appellant and respondent No.6 are not being paid salaries for the last two years and that the dispute between the

appellant and the management has become murky, we feel it appropriate that all the three Writ Petitions referred to above are heard and disposed of together as expeditiously as possible at the convenience of the learned Single Judge.

Accordingly, the Registry is directed to post WP.Nos.38517 and 31773 of 2014 along with WP.No.14231 of 2016 before the learned Single Judge. The parties are given liberty to request the learned Single Judge to hear all the three cases together expeditiously to give a quietus to the vexed litigation.

Subject to the above observations, the Writ Appeal is disposed of.

As a sequel to disposal of the Writ Appeal, WAMP.No.1766 of 2016 filed by the appellant for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) _________________ (G.Shyam Prasad, J) Dt: 9th August, 2016 lur
