THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No.16536 of 2015 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer in respect of Fair Price Shop No.24, Tummagunta Village, Kanigiri Mandal, Kandukur Division, Prakasam District. While so, the Enforcement Deputy Tahsildar, Kanigiri submitted a report on 08.11.2014, based on which 6-A proceedings were initiated.

It appears that the third respondent issued a show cause notice on 12.11.2014 to the petitioner-dealer. But, the petitioner has not submitted any explanation. The third respondent passed an order on 06.03.2015 suspending the authorization of the petitioner till completion of the enquiry. Now the petitioner submitted his explanation on 13.04.2015.

The present writ petition is filed challenging the proceedings of the third respondent dated 06.03.2015. In view of non-submission of the explanation by the petitioner to the initial show cause notice dated 12.11.2014 before passing the order dated 06.03.2015, it is not appropriate to interfere with the order passed by the third respondent on 06.03.2015. As the petitioner has already submitted his explanation on 13.04.2015, the third respondent is directed to complete the enquiry, within a period of sixty days, from the date of receipt of a copy of this order and pass appropriate final orders after observing the principles of natural justice. The Writ Petition is disposed of accordingly.

The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
