This writ petition is filed questioning inaction on the part of respondents 3 and 4 in taking note of the complaint of the petitioner dated 27.08.2019 whereby the petitioner has complained trespass by the persons named therein by breaking down the compound wall of his ancestral house and to declare the same as illegal and arbitrary. 2.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 20.09.2019 submits that basing on the complaint dated 27.08.2019 lodged by the petitioner, on 19.09.2019, an entry was made in the General Diary and after conducting preliminary enquiry, a case is registered in Crime No.598/2019, dated 19.09.2019 for the offences under Section 447 and 427 read with Section 34 I.P.C against the respondents 5 and 6 in the writ petition on the file of the third respondent police station and and the third respondent has taken up investigation in the matter. A copy of the said instructions dated 20.09.2019 along with F.I.R is placed on record.

Having regard to the submissions made by the learned Assistant Government Pleader on behalf of the official respondents and since a case is registered and investigation has been taken up, no further orders need be passed in the present writ petition as cause in the writ petition does not survive any more.

The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
