THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5169 of 2015 ORDER:

The grievance of the petitioner is that the respondents 2 to 5 are interfering with his possession and the 4th respondent, in particular, is proposing to dig canal through his agricultural land in an extent of Ac.3-19 cents situated in Survey No.117/1 to 4 of Vantaram village, Baljipeta mandal, Vizianagaram district, without acquiring the land and without paying compensation.

2. Considering the nature of urgency, the learned Assistant Government Pleader was directed to get instructions in the matter. Today when the matter was listed for admission, learned Assistant Government Pleader, having received instructions from the 4th respondent's office, submits that as of now no attempt is being made to dig canal through the petitioner's land; and if such a need arises and if the petitioner's land is required due to technical reasons, due process of law would be followed.

3. Recording the submission of the learned Assistant Government Pleader, the writ petition is disposed of with a direction to the respondents not to undertake digging of canal in petitioner's land without following due process of law by initiating acquisition proceedings under the Land Acquisition Act. No costs. Miscellaneous petitions, if any pending in this writ petition, shall stand closed. _____________________ CHALLA KODANDA RAM, J 10th March, 2015
