HON'BLE SRI JUSTICE SURESH KUMAR KAIT Criminal Petition No.15927 of 2016 ORDER:

Vide present petition, the petitioner/ A.1 seeks a direction, thereby to release him on bail in Cr.No.106 of 2016 of Tenali Taluk PS, Guntur District, registered for the offences punishable under Sections 120(B), 302, 307 read with 34 of IPC, Section 3(5) of SCs & STs (POA) Act, 1989 and Section 27 of Arms Act.

Learned counsel for the petitioner submits that the role of the petitioner as contained in the remand report is that the petitioner conspired and abetted the offenders to commit the said crime. However, he was not present at the spot of the offence and no recovery effected from him. He further submits that since 19.09.2016 the petitioner is in judicial custody and prays to release him on bail. Keeping in view the offences mentioned above, which are serious in nature and when matter is pending for investigation, I am not inclined to entertain the present petition.
