Guggila Sunitha, v. The Superintendent Of Police
Date: 18.06.2015 Between:
Guggila Sunitha .... Petitioner And The Superintendent of Police, Karimnagar, Karimnagar District and others.
... Respondents
ORDER:
The grievance of the petitioner is that the police authorities have mis-represented before this Court on 15.12.2010 when her earlier writ petition, W.P.No.30746 of 2010, was heard and disposed of. The misrepresentation is stated to be as to the filing of a final report before the Court concerned on 27.9.2009.
2. The Inspector of Police, Sircilla Police Station, Karimnagar District, filed a counter affidavit stating that Crime No.251 of 2008 was registered under Sections 447 and 427 I.P.C., on the file of Sircilla Police Station, Karimnagar District, basing on the complaint made by the petitioner and upon due investigation, the police found that it was not a fit case for criminal prosecution. Accordingly, a final report was submitted before the learned Judicial First Class Magistrate, Sircilla, on 27.9.2009, under Inward No.6625. A notice to that effect was also stated to have been served on the petitioner on 26.9.2009.
3. As the inward number has also been furnished by the police, the petitioner cannot complain that any mis-representation was made before this Court in the earlier round of litigation.
4. In the light of the conclusion arrived at by the police, it is for the petitioner, if she is aggrieved thereby, to avail appropriate remedies in accordance with law.
5. Reserving liberty to the petitioner to do so, the writ petition is closed.
6. Pending Miscellaneous Petitions in this Writ Petition shall also stand closed. No order as to costs.
