THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION NO.1881 OF 2012 ORDER:

This Civil Revision Petition is filed under Article 227 of the Constitution of India challenging the order, dated 15-03-2012 passed in I.A.No.714 of 2011 in O.S.No.57 of 2011 by the Principal Senior Civil Judge, Nellore, whereunder and whereby the application filed to reject the plaint as civil suit is not maintainable, was dismissed.

It is represented by the learned counsel for the respondent that the sole respondent-Chaluvadi Bhadrachala Rama Rao died on 24-12-2013 and he filed a memo, dated 29-04-2014 informing about his death. In spite of the same, no steps have been taken to implead the legal representatives of the sole respondent. Therefore, the revision is deemed to have been dismissed as abated by operation of law. 3.

Accordingly, the Civil Revision Petition is dismissed as abated by operation of law. No order as to costs. Miscellaneous petitions, if any pending, in this revision shall stand closed.
