THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON NO. 18099 OF 2018 ORDER:

Heard Sri Y.V. Ravi Prasad, senior counsel appearing for the learned counsel for the petitioner as well as the learned counsel for respondent No.4.

Learned Senior Counsel, during the course of arguments brought to the notice of this Court, the counter affidavit filed by respondent Nos. 1 to 3 and invited the attention to paragraph No.6 of the said counter affidavit. Based on the same, he informs the Court that no further orders are required in this Writ Petition. Acceding to the said request, the Writ Petition is dismissed as no further orders are required.

However, learned counsel for respondent No.4 brought to the notice of this Court the very same paragraph No.6 in the counter affidavit filed by respondent Nos. 1 to 3 and submitted that the bank is trying to adjudicate the disputes between the petitioner and respondent No.4.

Though the counter affidavit has been filed by respondent Nos. 1 to 3 and since the contract is between the petitioner and respondent No.4, respondent Nos. 1 to 3 have no role to adjudicate the disputes between the petitioner and respondent No.4.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
