HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION NO. 8613 OF 2007 O R D E R:

This Writ Petition is filed seeking a direction against respondents to consider petitioners' applications in priority for the post of Junior Lineman on contract basis by giving preferential consideration to the petitioners under the notification issued by the first respondent contending that these petitioners are qualified persons having a certificate in ITI in the trade of Electrician and passed the All India Trade Test conducted by the National Council for Training in Vocational Trades and sponsored by the Industrial Training Institute to undergo apprenticeship training in the divisions of Tirupati, Puttur and Madanapally of APSEB under the provisions of Apprentices Act, 1961.

Accordingly, petitioners underwent training and obtained certificate from Divisional Engineers of the respective zones and after completion of their apprenticeship training they are expected to be recruited in the vacancies of Junior Linemen by the respondents as held by the Apex Court in Kattite Valappil Pathumma and others vs. Taluk Land Board and others1 but the petitioners were denied consideration though they underwent apprenticeship training. Hence, the present Writ Petition.

MSM,J W.P.No. 8613 OF 2007 The respondent field counter specifically contending that the petitioners were not covered under the zone of consideration for appointment as Junior Linemen and they are not entitled to claim any relief since they were treated as fresh candidates for appointment as Junior Linemen.

The notification was issued in the year 2006 and the recruitment was over as on today and nothing remains in the process of selection as per the notification issued by the respondents. Since the petitioners were not covered under the zone of consideration they are not entitled to claim any relief in the present Writ Petition. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
