THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN ARBITRATION APPLICATION No.41 of 2012 ORDER:
This is an application seeking appointment of an Arbitrator and for requisite measure in terms of Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as 'the A&C Act'). 2.
Hearing the learned counsel for the parties in the light of the materials from the record, it is seen that there is an arbitration agreement between the parties and there are disputes for arbitration. 3.
Leaving open all questions, including arbitrability of the disputes and any bar as to limitation by law, all issues as between the parties are being dealt with in arbitration, requisite measure has to be taken by appointing an Arbitrator.

Today, the learned counsel for the parties on either side have jointly submitted that the parties have concurred and agreed to the appointment of Sri Kishore Rai, Advocate of this Court, as an Arbitrator.

In the result, the Arbitration Application is allowed appointing an Arbitrator.

Accordingly, Sri Kishore Rai, Advocate, Door No.8-2684/3/1/1/B, Road No.12, Banjara Hills, Hyderabad - 34 (Mobile No.9849846550), is appointed as Arbitrator to arbitrate on the disputes between the applicants and the respondents, including the claims and counter claims of both sides. The said Arbitrator shall enter on reference and proceed with, as enjoined by the A&C Act.
