2016-02-17Sanjay Kumar1 pages

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5081 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondent No.2 in preventing the illegal structures, construction activity being carried out by the respondents 3 and 4 in Sy.No.279/13 of Mancherial Shivar, Adilabad District, in unauthorized layouts without obtaining the permissions contrary to the Buildings Rules, by stating it as Survey No.279/1 is arbitrary and illegal and consequently issue a direction to the respondent No.2 not to allow any type of construction activity in Survey No.279/13 of Mancherial Shivar, Adilabad District and pass such other order or orders appropriate in the case."

However, the representation dated 14.09.2015 made by the petitioner to the Mancherial Municipality is delightfully vague and completely bereft of details. Unless the petitioner makes a proper representation setting out his grievance in detail, he cannot complain of inaction thereon by the authority concerned. In the light of the vagueness of the representation made by the petitioner, this Court is not inclined to entertain this writ petition alleging inaction on the part of the municipality.

The writ petition is therefore dismissed leaving it open to the petitioner to make an appropriate representation setting out in full detail his grievance as to the alleged irregularities and illegalities being committed by the respondents.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
