THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 4385 of 2017 ORDER:

This writ petition was filed challenging the action of the respondents in calling the petitioners to the Police Station and harassing and threatening them pursuant to the registration of Crime No.451 of 2016, dated 10.08.2016, by the Station House Officer, Chaitanyapuri Police Station, Cyberabad.

Learned Government Pleader for Home, on the basis of written instructions, submits that the complainant purchased plot No.237 admeasuring 200 square yards in Survey Nos.242, 245, 246 and 247 of Kuntlur Village, Hayathnagar, through registered sale deed, dated 17.07.2013 from Accused No.1 and he came to know that Accused Nos.7 and 8 are having GPA in respect of the said plot. He lodged a complaint before the police and the same was registered as a case in Crime No.451 of 2016 against the accused for the offences punishable under Sections 420, 448, 506 (2), 120-B IPC read with Section 156 (3) Cr.P.C. Based on the statement of the witnesses, the petitioners were asked to appear before the Investigating Officer along with related documents for proceeding with further investigation. The petitioners are not cooperating with the police for completion of investigation and filed the present writ petition. The investigation so far done established that the

petitioners have committed the offence by registering the very same plot to different persons including the complainant in the FIR. In view of the above averments, no orders can be passed in the writ petition when the investigation is pending, except stating that the Police shall follow due process of law during the course of investigation.

The writ petition is accordingly closed.
