THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 7460 OF 2017 O R D E R :
The case of the petitioner is that she is the absolute owner and possessor of the house property in an extent of 25 Ankanams bearing Door No. 4-493, Usman Saheb Pet, Nellore, SPSR Nellore District. Her main grievance is that the respondent authorities are trying to interfere with the above-said property, without issuing any notice of their intention, as is mandated under the provisions of the Hyderabad Municipal Corporation Act, 1955, as applicable to Nellore Municipal Corporation. Questioning the said action, the petitioner has filed this Writ Petition.
Heard learned counsel for the petitioner as well as learned Standing Counsel for the 2nd respondent Municipal Corporation Sri Ancha Pandu Ranga Rao.
In view of the grievance set out by the petitioner that the respondent authorities are trying to meddle with her house property, without even issuing any notice and calling for her objections thereto, interests of justice would be better served if a direction is issued to the respondent authorities not to take any coercive steps against the house property of the petitioner, without following the procedure as envisaged under the provisions of the 1955 Act.
The Writ Petition therefore, stands disposed of with a direction to the respondent authorities not to take any coercive steps against the house property of the petitioner without following the due process of law. No costs.
Consequently, the miscellaneous Applications, if any shall also stand disposed of.
