HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 23537 OF 2006 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in issuing Memo No.27826/ BG/ A1/ 2002, dated 30.10.2006, is illegal, arbitrary and un-constitutional; and consequently to set aside the same by holding that the advance increments ought to be merged in the scale of the concerned individual.

2) At the time when the matter is taken up for hearing, Sri P.Govind Reddy, learned Standing Counsel for Acharya N.G.Ranga Agricultural University placed on record e-mail sent by the Registrar, Acharya N.G.Ranga Agricultural University, Hyderabad, wherein it has been stated that the university has given all the benefits on Ph.D. increments though it was shown as personal pay. In the revised UGC pay scales of 2006, the fixation was made on the pay arrived after merging of Ph.D. increments, the question of recovery of amount from the individuals would not arise.

3) In view of the above, no further orders are necessary and accordingly, the writ petition is closed. There shall be no order as to costs.

4) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
