HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.10190 of 2017 ORDER:
The petitioner complains against the 3rd respondent in not receiving and processing the application of the petitioner for permission to fix shutter for the premises bearing No.4-5-298 on the main road of Sultan Bazar, Hyderabad, as illegal and contrary to Sections 428 and 461 of the Hyderabad Municipal Corporation Act, 1955.
The prayer of petitioner is substantially against the 3rd respondent in not receiving the application for the purpose referred to above.
Sri Ashok Kumar representing respondents 2 and 3 submits that the writ petition is premature and the petitioner can have a grievance, if an application was sent and respondents failed to act on the application, but not with what is stated in the writ affidavit. I have taken note of the limited prayer and the objection raised by the learned Standing Counsel.
As the complaint of petitioner is against the non receipt of application made by the petitioner to obtain permission under Sections 428 and 461 of the Act, I am satisfied the writ petition can be disposed of by this order.
The petitioner is given liberty to apply to the 3rd respondent for permission to fix shutter for
the premises bearing No.4-5-298 on the main road of Sultan Bazar, Hyderabad, by enclosing a copy of this order. The 3rd respondent is directed to examine the application, after hearing the 5th respondent as well, and pass orders within four weeks from the date of receipt of such request. The writ petition is disposed of accordingly. There shall be no order as to costs.
Miscellaneous applications, if any pending, shall stand closed.
