THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 32048 of 2016 ORDER:

This writ petition is filed seeking a direction to the respondents to release the retirement benefits to the petitioner consequent to his attaining the age of superannuation on 30.06.2014 It appears that while the petitioner was working as Assistant Accounts Officer-Electricity Revenue Officer at Banaganapalle, the Anti Corruption Bureau registered Crime No.7/RCT-Kunool/2013 in connection with a case against him. He submitted a representation on 16.04.2016 for release of retirement benefits, pending conclusion of trial in the said case. When the said representation was not considered, he filed the present writ petition. Learned counsel for the respondents is unable to show any rule prohibiting payment of retiral benefits during pendency of the criminal proceedings against the petitioner.

However, without recording any finding with regard to the entitlement of the petitioner, this Court deems it appropriate to direct the respondents to consider the representation, dated 16.04.2016, submitted by the petitioner and pass appropriate orders thereon within three months from the date of receipt of a copy of this order. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition
