THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.15163 of 2015 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner has been doing business in food grains under the name and style of M/s.Milap Traders at H.No.18-8-189/4, Yakutpura Chowki, Hyderabad. He is also the owner of Tata Pickup 407 vehicle bearing registration No.TS 07 UB 2430. On 22.04.2015, the third respondent inspected the premises of the petitioner and seized the available stock along with the vehicle. The value of the seized stock is Rs.61,967/-, whereas the value of the vehicle is Rs.1,50,000/-. A panchanama was conducted on the said date and a case under Section 6A of the Essential Commodities Act was registered. The petitioner is willing to furnish the bank guarantee for the said amount for release of the stock and the vehicle. When the petitioner filed an application on 02.05.2015 for release of the vehicle, no orders have been passed.

In those circumstances, he approached this Court by filing the present Writ Petition. In the above circumstances, this Court is not inclined to keep the Writ Petition pending and the second respondent is directed to release the value of the seized stock and the vehicle on condition of the petitioner furnishing a bank guarantee for a sum of Rs.2,11,967/- (Rupees two lakhs eleven thousand nine hundred and sixty seven only) within a period of one week from the date of receipt of a copy of this order.

The Writ Petition is disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
