L. Rani v. Smt. Shantha Kumari, Ias,
THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE K. LAKSHMAN CONTEMPT CASE No.1 3 0 5 of 2 0 1 9 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) This contempt case was instituted alleging wilful disobedience to the order dated 09.09.2019 in WP.No.4465 of 2019. 2.
Though the time granted by this Court, vide the said order, to prepare the seniority list is still available, the reason for institution of this case was the relieving of the petitioner from her post by the second respondent viz. the Commissioner, Telangana Vaidya Vidhana Parishad, Hyderabad, despite knowledge of the exercise which was directed to be undertaken by this Court.
3.
The second respondent was accordingly directed to be present before this Court today. The second respondent is present as directed and Sri A. Sanjeev Kumar, learned Special Government Pleader attached to the office of the learned Additional Advocate General, would inform this Court that the relieving order has been withdrawn and the petitioner is being continued in the service of the Telangana Vaidya Vidhana Parishad pending the exercise that has to be undertaken pursuant to the order in WP.No.4465 of 2019. Copy of the proceedings dated 28.09.2019 is placed on record. In that view of the matter, as the second respondent seems to have realized the lapse on his part, we are inclined to take a lenient view of the matter. The contempt case is accordingly closed. Pending miscellaneous petitions shall also stand closed. There shall be no order as to costs. _______________ SANJAY KUMAR, J _____________ K. LAKSHMAN, J September 30, 2019/ DSK
