THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.18106 OF 2018 ORDER:

Heard Sri. Akkam Eswar, learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for the respondents.

The petitioner challenges the notice dated 16.05.2018 substantially on the ground that the said notice is issued without affording an opportunity to him in any manner. On perusal of the said notice, prima facie, I am satisfied that the order for eviction is passed without affording an opportunity to the petitioner.

Hence, to meet the ends of justice, this Court directs the respondents to treat the notice impugned in the writ petition as a show cause notice and grants four weeks time from today to the petitioner to submit his explanation. The second respondent is further directed to consider the explanation on merits and also alternative prayers, if any, made by the petitioner and pass orders within six weeks thereafter.

The parties are directed to maintain status quo as regards possession and enjoyment over the subject matter of the writ petition as on date, for a period of eight weeks. Accordingly, the writ petition is disposed of. No costs. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
