THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.20295 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for respondents.

The petitioner is a dealer in seeds under the licence issued by the licensing authority and the licence is valid upto 20.11.2016. It has a processing unit in the name of M/s.SIKOSP Ginning Unit at D.No.3-42 in Sy.No.58/1, Bhoothpur Village & Mandal, Mahabubnagar District. While so, the fourth respondent submitted a report to the third respondent that, on his inspection on 13.05.2015, it was noticed that the petitioner-firm was not maintaining records. On the basis of such report, the ground stock available in the godown of the petitioner was seized on 13.05.2015. A show cause notice was issued to the petitioner on 23.05.2015 and 6-A proceedings are pending against the petitioner. In the proceedings dated 23.05.2015, the value of the seized cotton seeds was mentioned as Rs.22,69,200/-.

Now the petitioner is ready to furnish bank guarantee for the said amount provided the seized stock is released. In the circumstances, the third respondent is directed to release the seized stock belonging to the petitioner on furnishing a bank guarantee for an amount of Rs.22,69,200/- to the satisfaction of the third respondent. The petitioner shall renew the bank guarantee from time to time till the conclusion of 6-A proceedings against the petitioner. In view of the same, the show cause notice dated 23.05.2015 passed by the third respondent is set aside. The Writ Petition is, accordingly, disposed of.

As a sequel thereto, miscellaneous applications, if any, also stand disposed of.
