HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.18143 of 2018 ORDER:

Heard Sri S.M.Subhani, learned counsel for the petitioner and the learned Assistant Government Pleader (Assignment). 2.

The petitioner prays for the following relief: "to issue a Writ order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents particularly respondent No.4 for taking coercive steps for dispossessing / evicting the Petitioner from his Patta land situated in Sy.No.211/5A an extent Ac. 4.32 cents situated at Veera Kaveri Raju Puram, Nagari Mandal, Chittoor district without following the due process of law is being illegal, arbitrary, unconstitutional."

The petitioner relies on Endorsement, dated 20.06.2015, issued by 4th respondent for the limited purpose of satisfying the Court that the 4th respondent accepts purchase of property by petitioner through Registered Sale Deed, dated 01.04.1991, and has refused to issue Pattadar Pass Book and Title Deed. According to him, once the purchase is accepted and the 4th respondent finds the purchase by petitioner is contravening the provisions of the A.P. Assigned Lands (Prohibition of Transfers) Act, 1977, the petitioner shall be put on notice in Forms 1 & 2 and thereafter proceed, in accordance with law.

The Assistant Government Pleader submits that as the purchase by petitioner is contravening the prohibition under Act 9 of 1977, the respondents would follow the procedure and thereafter take possession.

Hence, the Writ Petition is disposed of by directing the respondents not to interfere with petitioner's possession and enjoyment, except in accordance with law. In other words, the respondents are given liberty to proceed under Act 9 of 1977. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
